AgooSMS provides a platform for sending SMS messages to recipients in Ghana and other supported regions. The Service includes web applications, mobile applications, and APIs for programmatic access.

3. Account Registration

To use our Service, you must:

Provide accurate and complete registration information
Maintain the security of your account credentials
Be at least 18 years old or have parental consent
Accept responsibility for all activities under your account

4. Acceptable Use

You agree NOT to use the Service to:

Send spam, unsolicited messages, or bulk commercial messages without consent
Harass, threaten, or abuse others
Send fraudulent, deceptive, or misleading content
Impersonate any person or entity
Violate any applicable laws or regulations
Transmit malware, viruses, or harmful code
Interfere with or disrupt the Service
Send messages containing illegal content
Violate the privacy rights of others

5. Sender ID Guidelines

Custom Sender IDs are subject to approval. We reserve the right to reject or revoke Sender IDs that:

Impersonate other businesses or organizations
Contain offensive or inappropriate content
Violate trademark or intellectual property rights
Are misleading or deceptive

6. Payment and Billing

Prepaid Balance: The Service operates on a prepaid basis. You must maintain sufficient balance to send messages.

Pricing: SMS pricing is displayed in Ghanaian Cedis (GHS). Prices may vary based on message length and destination.

Refunds: Account balances are non-refundable except where required by law or at our discretion.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. Message delivery depends on mobile network operators and factors beyond our control. We are not liable for delayed or failed message delivery.

8. Intellectual Property

The Service, including its design, features, and content, is owned by AgooSMS and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our written permission.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AGOOSMS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

10. Account Suspension and Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, suspected fraudulent activity, or any reason at our sole discretion. Upon termination, your right to use the Service ceases immediately.

11. Indemnification

You agree to indemnify and hold harmless AgooSMS, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

12. Changes to Terms

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ghana, without regard to its conflict of law provisions.
